Brief Description of the Zoning Review Process

Developers must apply to Licenses & Inspections for a zoning permit that authorizes construction. L&I reviews the construction plans for compliance with Philadelphia zoning regulations. If the plans are not in compliance, L&I issues a refusal. Zoning refusals may be appealed to the Zoning Board of Adjustment for a variance or special exception.

Before a developer can present his appeal before the ZBA, he is required to present his plans at a public meeting at a Registered Community Organization such as CRCA.

ZBA hearings are open to the public. Organizations such as CRCA may choose to send a letter of support, non-opposition or opposition to the ZBA, and they may testify at the hearing to present their position. Any member of the public is also free to send letters expressing their position and they are also free to testify at the ZBA hearings.

4136-40 Mitchell St Civic Design Review Conclusion

The developer is proposing to build a 38 ft. detached building with 72 single-family residential units with 8 space interior parking garage. The property is zoned CMX-2. Because of its scale, this project requires a Civic Design Review (CDR). Here is a copy of the required Public Notice. And here is a link to the developer's CDR application which includes plans.

CRCA held the required public meeting where the developer presented his project on November 3, 2016. See the meeting minutes.

The initial Civic Design Review (CDR) was held on 11/29/2016. After a follow up meeting, the CDR Committee of the City Planning Commission sent this report to the Department of Licenses and Inspections.

The applicant's request for variance was denied on 4/23/14 (see Appeals Denied by the ZBA below) but is being re-heard by the ZBA on the basis of a modified request. Here is the explanation from the applicants representative:

"Our client appeared before the Zoning Board of Adjustment on April 23, 2014 to request a variance for a two family dwelling. The variance was denied as the ZBA determined that this was an “overuse of the property.” However, the ZBA granted our motion for reconsideration, and will re-hear the variance request. My clients are now proposing to simply close the plumbing office on the first floor and relinquish any legal right to such use, and seek legalization of the currently existing two apartments on the first floor and the apartment on the second floor.

The parcel is an existing RSA-5 Residential District, and the applicant was issued a use refusal for; (1) The proposed use, two additional family dwellings is not permitted in this zoning district. No new construction or increase in use from what currently exists is contemplated by the pending application."
